City of El Paso v. Fort Dearborn National Bank

Error to the Court of Civil Appeals for the Fourth District, in an appeal from El Paso County. The Fort Dearborn National Bank and others sued the City of El Paso in trespass to try title, and recovered judgment which was affirmed on defendant’s appeal. The city then obtained writ of error.

The defendants in error as plaintiffs in trespass to try title recovered in the District Court judgment against the city for block 8 in survey No. 9, Hart’s addition to the city of El Paso. The writ of error was granted from a judgment of the Court of Civil Appeals affirming the judgment of the District Court. The plaintiffs below derived their title from the heirs of Simeon Hart, who died intestate in January, 1874.
