Our opinion of December 10, 1964 is withdrawn and the following opinion is substituted therefor.

Appellee, Celina F. Trevino, joined pro forma by her husband Salvador Trevino, sued appellant to recover damages for the unlawful, intentional and malicious conversion of merchandise allegedly owned by her, and also to recover exemplary damages. Appellant has appealed from the judgment of the trial court based on the jury findings: that appellee was the owner of the goods in question consisting of the contents of 17 cartons and 8 packages that entered the United States from…
