Safe Environment of America, Inc. (“Plaintiff’) brings this action against Em ployers Insurance of Wausau, A Mutual Company (“Defendant”), to recover on a payment bond executed by Eastern General Contractors (“Eastern”) to the United States pursuant to the Miller Act, 40 U.S.C. §§ 270a to 270d (2001) (recently recodified at 40 U.S.C. §§ 3131, 3133 (2003)).
