State v. Mata

Court of Appeals of Washington

Decided March 18, 2014No. 30466-3-IIIPublishedCited by 6 opinions

1Opinion of the Court

Siddoway, A.C.J.

¶1 Joe Mata appeals his convictions of robbery, attempted robbery, and first degree unlawful possession of a firearm. We conclude that this second prosecution for unlawful possession of a .45 caliber handgun violates his right to be free of double jeopardy and reverse his conviction on that count. We find no other reversible error, nor does Mr. Mata raise any viable issue in his pro se statement of additional grounds. We reverse his conviction of unlawful possession of a firearm and remand for resentencing.
