— Judgment, Supreme Court, Bronx County (Ramos, J.), rendered September 9, 1980, convicting defendant of robbery in the second degree and sentencing him to an indeterminate term of two to six years, unanimously reversed, on the law, and the matter remanded for a new trial. At about 5:25 a.m. on July 18, 1979 and within 5 to 10 minutes after he had been robbed, Michael Sumter, the victim, who was cruising the neighborhood in a marked police vehicle with two officers, spotted the two perpetrators, one of whom was defendant.
