HOFFMAN, Presiding Judge.

Defendant John Foster Fyock appeals from Ms conviction in a trial to the court for possession of a controlled substance, a class D felony. He was sentenced to two years imprisonment. On March 19,1981 his motion to correct errors was denied and he subsequently perfected this appeal.
