Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which denied petitioner’s application for performance of duty disability retirement benefits.

Petitioner, a police officer for the Town of East Greenbush in *677Rensselaer County, applied for performance of duty disability retirement benefits based upon lower back injuries that he sustained in November 1996 while attempting to lift a stretcher into an ambulance.
