This suit was brought by appellee against the appellant to recover damages for the alleged negligent failure of appellant to make delivery of a telegram received by it for transmission and delivery to appellee informing him of the death of his brother. The damages claimed are for mental anguish caused by the inability of appel-lee to attend his brother’s funeral, which it is alleged resulted from the negligence of appellant in failing to make delivery of the telegram.
