Judgment, Supreme Court, Bronx County (William H. Wallace, III, J.), rendered March 18, 1993, convicting the defendant, after a jury trial, of criminal sale of a controlled substance in the third degree and two counts of criminal possession of a controlled substance in the third degree and sentencing him, as a second felony offender, to concurrent indeterminate terms of imprisonment of from four and one-half to nine years, unanimously reversed, on the law, the judgment is vacated and the matter is remitted for a new trial.
