In a proceeding pursuant to CPLR article 78 inter alia to review appellants’ determination, dated June 13, 1973, denying petitioner’s application for a zoning variance, the appeal is from a judgment of the Supreme Court, Westchester County, dated March 11, 1974, which annulled the determination and remanded the application to appellants for further consideration so that a variance or exception may be granted. Judgment affirmed, without costs. No opinion. Rabin, Acting P. J., Latham, Cohalan and Christ, JJ., concur; Hopkins, J., dissents and votes to reverse the judgment and confirm the…
