McLaughlin, J.:

These are motions to dismiss separate indictments found' against each of the defendants above named accusing them; *54under the first count of the crime of manslaughter in the first degree and under the second count of the crime of manslaughter in the first degree in each instance excepting as to the defendant Finlay who is by the second count accused of the crime of manslaughter in the second degree.
