The motion by respondent tenant Marie Jackson, for, inter alia, leave to amend her answer and for summary judgment pursuant to CPLR 3212 (b), is granted in part and denied in part.
*797For approximately 32 years, tenant has been residing at the subject premises located at 1515 Macombs Road, apartment 507, in the Bronx, New York, owned and managed by petitioner landlord 1515 Macombs Road, LLC.
