MEMORANDUM OF DECISION AND ORDER

This action arises from personal injuries sustained by the plaintiff, Kyle Hartry (“Hartry” or “Plaintiff’), during an attack by a fellow inmate that occurred on October 24, 2007 while the Plaintiff was incarcerated at the Suffolk County Correctional Facility (“SCCF”).
