This is an action between Stanley P. Clay and the Missouri State Highway Commission to ascertain and determine the fee-simple title to the North 550 feet of the S. E. 1/4 of the N. E. 1/4 of Sec. 10, Twp. 28, R. 32, except the Missouri Pacific Railroad Company’s right of way thereover, in Jasper County, Missouri. The trial was to the court without a jury. Judgment was for the Highway Commission, defendant, and plaintiff appealed.
