¶1 Zirkelbach Construction, Inc. (Zirkelbach) appeals from the order of the Thirteenth Judicial District Court, Yellowstone County, granting DOWL, LLC’s (DOWL) motion for partial summary judgment. We affirm.

¶2 We restate the issue on appeal as follows:
