Eugene Bolle (hereinafter called plaintiff) brought suit in the circuit court of Lake county against the Chicago and Northwestern Railway Company, (hereinafter called defendant,) a common carrier engaged in both interstate and intrastate commerce, to recover damages under the Federal Employers’ Liability act for an injury alleged to have been sustained by plaintiff while engaged as an employee of defendant in interstate commerce.
