The District Attorney of Chester County filed a complaint in *771equity in the name of the Commonwealth, pursuant to the Act of April 12, 1951, P.L. 90, art. VI, sec. 611, 47 P.S. §6-611 (hereinafter, the “Liquor Code”), seeking to enjoin the operation of the Conestoga Farms Tavern (hereinafter, the “Tavern”), a bar and restaurant owned by a partnership consisting of the three named defendants. The complaint alleges in essence that the operation of the Tavern constitutes a common nuisance and seeks a permanent injunction prohibiting the operation of the premises as a restaurant…
