Boyd Kelly Brost, the natural father of two minor children, petitioned the Thirteenth Judicial District Court, Yellowstone County, to issue a writ of habeas corpus and remove the children from the physical custody of Waneta Glasgow, their maternal grandmother. Thereafter, the grandmother and her second husband petitioned to adopt the children. The two actions were consolidated by stipulation of the parties.
