This was a suit instituted by Driggers & Carr, hereinafter referred to as plaintiffs, against St. Louis & San Francisco Railway Company, hereinafter referred to as defendant, filed in the superior court of Grady county, Okla., on July 19, 1912, for damages in the sum of $434.50 for failure to promptly transport and deliver 110 head of cattle received from Ft. -Sill, Oklahoma, on June 20, 1910, to Kansas ‘City, on account of shrinkage and declining market.
