Allen Galbreath was arrested for disorderly conduct while performing his morning ballet exercises in an Oklahoma City park. He brought a civil rights action under 42 U.S.C. § 1983 against the arresting officer and the City, alleging the arrest lacked probable cause and the municipal ordinance was unconstitutionally vague. Each defendant moved for summary judgment, and Mr. Galbreath moved for declaratory judgment on his claims against the City.
