The plaintiff herein commenced an action in the district court of Red Willow county to recover damages alleged to have been sustained by him on account of a malicious prosecution instituted against him by the defendant. The petition was in the usual form, and Avas sufficient to sustain a verdict in plaintiff’s favor. The prosecution complained of was based upon the folhnving complaint:
