—In a proceeding pursuant to CPLR article 78 to review a determination of the respondent New York City Department of Environmental Protection, dated May 4, 2000, which denied the petitioner’s application to compel the respondent New York City Department of Environmental Protection to reject the bid submitted by the respondent A.J. Pegno Construction Corp./Tully Construction Company, Inc., and award the contract to the petitioner, the appeal is from a judgment of the Supreme Court, Queens County (Berke, J.), dated July 11, 2000, which denied the petition and dismissed the proceeding.
