This is a certified question from the Court of Civil Appeals for the Third Supreme Judicial District, The statement and questions are as follows:
“This is a mandamus suit brought by J. W. Riggins against the members of the city council of the city of Waco and Allan D. Sanford, the acting mayor of said city, by which Biggins seeks to be restored to the office of mayor, from which he has been removed by the city council.
