This case arose out of an automobile collision involving plaintiff Quinton Neely and defendant Norman Terry Jones. Jones filed a motion to dismiss or for summary judgment and later filed a renewed motion after the case was transferred from the Superior Court of DeKalb County to the Superior Court of Coweta County. He argued that he was entitled to judgment based on Neely’s failure to serve him within the statute of limitation, as well as Neely’s failure to exercise due diligence in attempting to perfect service after learning that service was insufficient.
