Michael Patrick Kennedy pleaded guilty to the crime of aggravated assault of a police officer. See Tex. Penal Code Ann. §§ 22.01(a) (defining assault), 22.01(b)(1) (providing that assault is third degree felony if it is committed against public servant engaged in his official duties), 22.02(a) (defining aggravated assault in relation to definition of assault found in section 22.01), 22.02(b)(2)(B) (West Supp.2010) (specifying that aggravated assault is first-degree felony if committed against public servant performing his official duties).
