This appeal emanates from a declaratory judgment action brought by appellant Professional Rental, Inc. (“Professional”) against its insurer, appellee Shelby Insurance Company (“Shelby”). In this action, Professional sought a declaration that Shelby was obliged to defend and indemnify it with respect to certain United States Environmental Protection Agency (“EPA”) claims.
