This suit was commenced on the 12th day of March, A. .D. 1878, to recover the amount due on three certain promissory notes made by appellees to appellant, dated November 8, 1875, bearing interest at the rate of ten per cent, per annum, and providing that if the interest be not paid annually the same to become principal and bear the same rate of interest.
