The defendant, doing business as the Northeast Preserving Works, entered into a contract with the Door County Equity Elevator Company on February 1,1911, for the purchase of 800 bushels of peas, at $3.00 a bushel. The vendors guaranteed to deliver at least seventy-five per cent, of the quantity contracted for, the contingency of a short crop being taken into consideration.
