The defendant was tried upon a charge of murder of the first degree and was convicted of manslaughter. He appeals from the judgment and from an order denying his motion for a new trial.
The information charged the defendant with the murder of one John P. Pawley on the twenty-seventh day of January, 1908. It appeared that on that day he shot Pawley with a pistol, inflicting a wound from which Pawley died on February 17, 1908.
