The relator was first appointed by the board of trustees of the village of Batavia as engineer at the municipal water works plant about nineteen years ago, and annually thereafter, with the exception of one year about ten years ago, was reappointed, on his application, at the first meeting of each newly-elected board of trustees, following the annual election of trustees, at which all village appointments were, made, sometimes, according to the minutes, without term, sometimes for one year and sometimes at the pleasure of the board, until the meeting held on the 16th day of *116March, 1910, when…
