MEMORANDUM DECISION AND ORDER

J. THOMAS GREENE, District Judge.

This matter is before the court on defendants’ motion to dismiss or in the alternative for summary judgment. Frank P. Dickson, Jr. represents the plaintiff, and John B. Pound represents the defendants. The court heard extensive argument of counsel and received post hearing supplemental memorandums and materials, after which the matter was deemed submitted for decision.
