Assumpsit, upon a policy of insurance of a certain brick store of the plaintiff, destroyed by fire on the 21st day of September, 1844. The plaintiff’s application, of the date of the 21st of August, 1887, after stating the size, position, and some other particulars descriptive of the store insured, states that it is “ occupied by tenants, including a cabinet-maker tenant in the third story.”
