Error to the Circuit Court of Cuyahoga county. Action of replevin by mortgagee of chattels, against officer who levied an attachment on the mortgaged property after the mortgagee had taken possession, and the attaching creditors. Judgment for plaintiff! affirmed by circuit court. Case stated in opinion.

'The record shows that William R. Ryan, the- defendant in error, sold, a stock of drugs and meichandise consisting of such articles as are usually kept in a retail drug-store] to Eugene Louselle, who gave Ryan a mortgage on the property to secure the payment of three notes, maturing at different dates, and which were given by the mortgagor for the purchase price of the goods. The mortgage, which was duly executed, verified, and filed with the proper officer, contained the following stipulation: “It is hereby understood that whatever portions of said stock that may be sold in general trade,…
