Appeal from a judgment of the Supreme Court (Lamont, J.), rendered October 14, 2005 in Albany County, upon a verdict convicting defendant of the crime of assault in the second degree.
Defendant was charged in an indictment with assault in the first degree, assault in the second degree and criminal possession of a weapon in the fourth degree. The charges arose from an incident in which a fistfight broke out after defendant and the victim engaged in a game of “beer pong” at a party.
