We also agree with the Commonwealth that the single justice's reinstatement of the direct appeal is at odds with the earlier order of a different single justice, in 1994, denying White's request to have the trial court record assembled and transmitted to this court. The single justice here was of the view that the earlier order merely denied a request for the transmittal of the record, and did not necessarily deny an actual reinstatement of the direct appeal.
