Appeal from the Chancery Court of Fayette. Heard, before the Hon. Thomas Cobbs. The bill in this case was filed on the 14th April, 1890, by Mrs. J osephine E. J ones, against her husband, or late husband, W. W. Jones, and sought a divorce on the ground of abandonment, and alimony. The parties were married in December, 1881, and lived together as man and wife, according to the allegations of the bill, until April, 1887, when the defendant drove his wife from his house.

This is a suit by the Avife against her husband for a divorce from the bonds of matrimony, and for alimony. It is contended for the appellant that all claim to such relief was barred by the act of the General Assembly of Alabama releasing him from the bonds of matrimony theretofore existing betAveen him and the appellee. — Acts of Ala. 1888 89, p. 361. If that act was valid, no divorce could be decreed in this ease, as the bonds of matrimony had already been dissolved Avhen the bill was filed.
