Appeal by the defendants, Bernath Krausz, as marshal of the city of New York, and others, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Queens on the 26th day of April, 1901, upon the verdict of a jury for $800, and also from an order entered in said clerk’s office on the 29th day of April, 1901, denying the defendants’ motion for a new trial made upon the minutes.

Willard Bartlett, J.:

This action was brought to recover damages for the alleged conversion of a stock of goods claimed to belong to the plaintiff in her business as a florist in the city of New York. The defendants sought to justify the taking of these goods under a judgment recovered by Richard and Henry Pritchard against the property of George Polykranas, the husband of the plaintiff. The question of ownership was, therefore, the first question to be determined upon the trial.
