delivered the opinion of the Commission of Appeals, Section B.

The suit was filed by plaintiffs in error against many defendants to recover title and possession of an undivided one-fourth interest in the oil, gas and other minerals in a tract of land in Rusk County containing 25 acres, and for damages on account of oil produced and taken. In the trial court and in the Court of Civil Appeals the case was complicated by conflicting claims of many parties, but as presented here the case calls for the decision of one question of procedure and of two or three related or…
