The matter before this Court involves the legality of the incorporation of the City of Robards in Henderson County, Kentucky. On July 22, 1997, a petition was filed with the Henderson Circuit Court pursuant to KRS 81.050 et seq. to incorporate an area in southern part of the county. There is no issue that the document filed complied with all the statutory requirements. The Henderson Circuit Court set the incorporation hearing for September 9, 1997.
