Plaintiff’s action is for negligent injuries sustained in a collision of automobiles. Defendant filed counter-declaration for damages arising from the same collision. The jury returned a verdict of not guilty as to both actions. Plaintiff appeals.

At conclusion of the proofs, plaintiff moved for directed verdict in defendant’s counteraction, upon tbe ground that defendant could not recover as he had been guilty of negligence as a matter of law.
