The plaintiff in error was plaintiff and defendant in error defendant in the trial court. The declaration, after averring, in the usual way, that the defendant was the owner of certain tracks, turnouts, etc., in State street between Madison street and Thirty-ninth street, in the city of Chicago, for the purpose of operating cars therein and carrying passengers, avers that it was the duty of the defendant to construct, furnish, maintain and provide, for such purpose, a safe track and safe appliances and machinery; “that contrary to…
