Appeal from a judgment of the Supreme Court (Coutant, J.), entered September 24, 1999 in Broome County, *591which granted petitioner’s application, in a proceeding pursuant to Election Law § 16-102, to declare valid the independent nominating petition naming petitioner as the Libertarian Party candidate for the office of City Council of the City of Binghamton, Sixth District, in the November 2, 1999 general election.
