It appears from the record that in the action of the plaintiff against defendant Peters, a writ of attachment was issued and the same was served upon B. L. Sabin, attaching in his hands all property of the defendant. Answering the writ in the first instance, Sabin said in substance that he had nothing in his hands belonging to the defendant.
