*979Proceeding pursuant to CPLR article 78 (transferred to this Court by order of the Supreme Court, entered in Albany County) to review a determination of respondent which found petitioner guilty of violating certain prison disciplinary rules.

During the processing of petitioner’s personal property after his transfer between correctional facilities, a correction officer found a glass shank, a metal shank and a metal rod taped to the inside of petitioner’s radio.
