(dissenting). The plaintiff, Mary A. Galbraith, was injured in an automobile accident on the 27th day of May, 1932, and she has sued the driver of the car in which she was riding, Paul Busch, and the owner, Sarah M. Galbraith, her daughter, to recover damages for injuries. Paul Busch, the driver, and the owner of the car were sitting in the front seat; the plaintiff and her grandson were seated in the back seat.

The occupants were proceeding from Poughkeepsie to the Adirondaeks over the Albany Post Road. The place of the accident was about twelve miles north of Hudson, where the…
