RITCHIE, District Judge.

I agree generally with the opinion and findings of the probate judge. I do not agree with his conclusion that the appointment of Jean Tjosevig “was illegal” and “without warrant of law.” It was a gross atluse of discretion, because before the appointment was made the court had before it the petition of Jean Tjosevig and the petition of Elizabeth Underwood, each stating under oath that the estate was worth less than $2,500, and the petition of Mrs. Underwood asked that it be set apart to her under the statute.
