Plaintiffs appeal from a final judgment of the United States District Court for the Western District of New York, John T. Curtin, Judge. The district court granted summary judgment pursuant to Federal Rule of Civil Procedure 56 and judgment as a matter of law pursuant to Federal Rule of Civil Procedure 50(b) in favor of defendant Curtiss-Wright Corporation (“Curtiss-Wright”) and dismissed plaintiffs’ claims, which were brought under Section 502 of the Employee Retirement Income Security Act of 1974 (“ERISA”), codified at 29 U.S.C. § 1132, and Section 301 of the Labor…
