It seems to be thought by counsel for appellant, that notwithstanding the judgment of affirmance in the Appellate Court, controverted questions of fact may still be reviewed in this court, because, as is said, the Appellate Court has not expressly found, in terms, against appellant on these questions, and because portions of its opinion are inconsistent with and negative the presumption of such a finding. This position is untenable. Sections 87 and 89 of our Practice act (chap. 116,) prohibit this court from re-examining controverted questions of fact in all cases of this kind. We may-look…
