On this appeal from the circuit court of Rock Island County, petitioner, Tennie Weaver, complains that his petition filed pursuant to the Post-Conviction Hearing Act (Ill. Rev. Stat. 1967, ch. 38, par. 122 — 1 et seq.) was improperly denied.
Weaver was tried by a jury, found guilty of the crimes of burglary, possession of burglary tools and theft, and sentenced to imprisonment in the penitentiary. Upon direct appeal his conviction and sentence were affirmed. (41 Ill.2d 434, cert. den. 395 U.S. 959.) This petition for post-conviction relief was then filed where it is alleged that in several…
