' Upon the trial, the intervention of a jury having been waived, and the action submitted to the court, a judgment was directed in favor of the plaintiff for the sum of §9,519.16. The defendant now moves for a new trial.

The plaintiff is a limited partnership association, under the laws of Pennsylvania. By article 16, § 13, of the constitution of that state, the term “corporation,” as used in the article, is to be con*670strued as including all joint-stock companies or associations having any of the powers or privileges of corporations not possessed by individuals or…
